Terms of Service

These Terms of Service ("Terms") govern your use of the VapeDash website, mobile apps and delivery service (together, the "Service"). By creating an account or placing an order you agree to them. If you do not agree, please do not use the Service.

1. Who we are

VapeDash is operated by Tim Obidov from Nelspruit (Mbombela), Mpumalanga, South Africa ("VapeDash", "we", "us"). Contact: tim.obidov@gmail.com or 073 460 4026. VapeDash provides an on-demand delivery platform: you order products from licensed local vape shops that partner with us, you pay VapeDash by card, and our own drivers deliver your order to you.

2. You must be 18 or older

  • The Service is for adults only. You may not create an account, order or receive an order if you are under 18.
  • When you sign up you must confirm that you are 18 or older. Our drivers check at the door that the person receiving the order appears to be 18 or older, and may ask to see ID. If the recipient appears to be under 18, cannot be reached, or the driver is unsure, the driver will not hand the order over and it will be returned and refunded under our Refund & Returns Policy.
  • You must not buy products on behalf of anyone under 18. Giving false information about your age is a breach of these Terms and may be unlawful.

3. Your account

You need an account to browse the catalogue and order. Provide accurate information, keep your password confidential and tell us promptly if you suspect unauthorised use. You are responsible for activity on your account. We may suspend or close accounts that breach these Terms or the law.

4. Products and health information

  • Products are supplied by our partner vape shops. Product names, descriptions, images and nicotine strengths are provided for information; images are illustrative.
  • Products containing nicotine are addictive and carry the health warning shown on every listing. Products are not smoking-cessation or medical products and we make no health claims about them.
  • Keep all products out of reach of children and pets. Do not use products if you are pregnant or breastfeeding, and read the manufacturer's instructions.

5. Prices and payment

  • All prices are in South African Rand (ZAR). Delivery is a flat fee (currently R35) and is free when your basket is R400 or more. There is no service fee or small-order fee. The delivery fee, if any, and the total are always shown before you pay.
  • Payment is by debit or credit card only (Visa and Mastercard), processed securely by our payment provider Paystack. Card details are entered on the payment provider's secure page and are never seen or stored by VapeDash. We do not accept cash on delivery.
  • Your order is placed when your payment is successful. Unpaid orders are cancelled automatically after a short time and any reserved stock is released.
  • Partner shops set their own product prices. Prices can change; the price you see when you place your order is the price you pay, and orders already placed are not affected by later price changes.

5A. VapeDash Plus (optional subscription)

  • VapeDash Plus costs R49 per month, billed by card through Paystack, and gives free delivery on every order while it is active. The price can change; we will tell you before a change takes effect.
  • It renews automatically each month until you cancel in the app. If you cancel you keep the benefits until the end of the month you have paid for. Subscription fees for a month already started are not refunded, unless the law requires it.
  • Loyalty points: you earn 1 point for every R10 spent on products once an order is delivered. Points have no cash value, and rewards will be announced before points can be redeemed.

6. Delivery

Delivery is described in our Delivery Policy. Delivery times are estimates. You must provide an accurate address and be reachable by phone to receive your order.

7. Cancellations, refunds and returns

See our Refund & Returns Policy. Nothing in these Terms limits any right you have under the Consumer Protection Act 68 of 2008 (CPA) or the Electronic Communications and Transactions Act 25 of 2002 (ECTA).

8. Acceptable use

You must not misuse the Service: no fraud or chargeback abuse, no attempts to buy for minors, no harassment of drivers or staff, no interference with the apps or website, and no use of the Service for anything unlawful. Drivers may refuse to deliver to anyone who is abusive, intoxicated or unable to show they are an adult.

9. Intellectual property

The VapeDash name, apps, website and content belong to us or our licensors. You may use them only to use the Service.

10. Our responsibility

We take reasonable care to provide the Service. To the extent the law allows, VapeDash is not liable for indirect or consequential loss, or for events outside our reasonable control (for example network outages, severe weather or road closures). Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability under the CPA.

11. Privacy

We handle personal information as described in our Privacy Policy, in line with the Protection of Personal Information Act 4 of 2013 (POPIA).

12. Changes and ending the Service

We may update these Terms or the Service. Material changes will be notified in the app or on this website. Continued use after a change means you accept it. You can delete your account at any time from the app.

13. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. Please contact us first at tim.obidov@gmail.com or 073 460 4026 so we can try to resolve a complaint. You may also approach the National Consumer Commission or the courts of South Africa.
